Welcome to Rubaroc.com! This website is provided by Rubaroc® ('Rubaroc') as a service to our customers. Please review these terms and conditions which govern your use of our website. Note that your use of Rubaroc.com constitutes your unconditional agreement to be bound by these terms and conditions (the "Terms"), Rubaroc® Shipping Policy, Rubaroc® Return Policy and Rubaroc® Privacy and Security Statement.
1. Your use of the website
1.1 Your use of Rubaroc.com constitutes your acceptance of ours Terms. By accepting the Terms through your use of Rubaroc.com, you certify that you are the age of majority in your jurisdiction of residence. If you are under the applicable age of majority, you may only use Rubaroc.com under the supervision of your legal parent or guardian who has agreed to the Terms. If you are the legal parent or guardian, you agree to monitor and supervise the minor's use of Rubaroc.com and agree to be responsible for such minor's use of Rubaroc.com, including any financial charges or legal liability incurred.
1.2 If it is determined that a person under the age of majority has provided personal information to Rubaroc.com, we will delete the information as soon as possible. If you become aware that such information has been provided, please contact us at info@Rubaroc.com so that the information can be deleted.
2. Code of Conduct
2.1 You agree that you will not do any of the following (collectively, the 'Code of Conduct'):
2.2 Restrict or inhibit any other visitor from using Rubaroc.com, including, but not limited to, "hacking" or defacing Rubaroc.com;
2.3 Use Rubaroc.com or content on or from Rubaroc.com for any illegal purpose;
2.4 State or imply that any remarks you make are endorsed by Rubaroc®.
3. Copyrights, Trademarks, and Patents
3.1 The names, trade names, logos, service marks, trademarks, and trade dress on Rubaroc.com are registered and unregistered trademarks of Rubaroc® and our affiliates. Use of Rubaroc.com does not grant any license or right to use any Trademark displayed on Rubaroc.com. Rubaroc®, and our affiliates require prior written approval for the use of the "Rubaroc®" (Rubaroc's Logo), or any other Trademarks, as part of a link to or from any website.
Dealer Trademark Agreement
1. The Dealer shall have no authority to use the trademarks, copyrights and any other intellectual property (hereinafter "Marks") owned by Rubaroc except as expressly outlined in this agreement. Marks under this agreement shall be defined as all trademarks, service marks, logos, trade dress, or other indicia owned or franchised by Rubaroc or any of its affiliates or related companies and shall include copies similar or confusingly like the trademarks, service marks, logos, trade dress, or other indicia. Dealer acknowledges ownership by Rubaroc of the Marks, the various registrations of the Marks and applications for registration of the Marks as well as the validity of the Marks and registration.
2. Dealer agrees that it will not infringe or contest, directly or indirectly, the validity of, or Rubaroc's title to the Marks registration or other applications or assist others in such activities. It is further understood and agreed that Dealer has no right to any of the Marks now owned or used by Rubaroc or which may be owned or used by Rubaroc at any time in the future, and that all goodwill from the use of such Marks by Dealer shall inure to the benefit of Rubaroc.
3. Upon the Dealer ceasing to purchase a product from or trade with Rubaroc, the Dealer agrees, insofar as it may have received authorization to use the Marks, to discontinue all use of the Marks under which the Dealer has been operating. The Dealer shall have no right to acquire the marks by purchase or otherwise
4. The form and manner of use of each Mark shall be determined by Rubaroc and Dealer shall submit to Rubaroc for approval in advance all proposed uses of the Marks, including, but not limited to, advertising, labels, notices and publicity materials. Dealer agrees not to use any of the Marks for any purpose or in any published or unpublished context without the express written consent of Rubaroc.
Member Policy
Contractors are independently owned and operated purchasers of Rubaroc materials only and are not affiliated with, agents, dealers, franchisees, certified installers, factory trained installers or representatives of Rubaroc® or its affiliates and so shall not present themselves as such to their clients.
Rubaroc makes no representations or warranties and is not responsible for, the performance, acts or omissions of such parties. It is the ultimate responsibility of the property owner (end-user) to select a Rubaroc installer based upon their individual assessment of such installer or contractor.
Contractor agrees to assume all responsibility for any installation performed using Rubaroc materials as per the Rubaroc Material Limited Warranty & Disclaimer. Purchase and/or use of any Rubaroc materials indicates agreement with the Material Limited Warranty & Disclaimer.
Rubaroc materials must be purchased from a Rubaroc location or from Rubaroc.com for the material to be called “Rubaroc” and for the limited warranty to apply.
By becoming a Rubaroc member you are authorized to act on behalf of your company and agree that any installations you or your company perform is solely your own or your companies responsibility. You or your company agree to not hold Rubaroc® or its affiliates responsible for any installations that are incomplete, unsatisfactory or damaged, neither now or in the future, by your own or your companies’ client(s).
Rubaroc® or its affiliates are not responsible for any replacing, finishing, and/or fixing installs originally performed by the agreeing Rubaroc Member. Your use of softrroc.com and Rubaroc member application constitute your agreement to the Member Policy.
Contractor Material Limited Warranty & Disclaimer
Coverage: Average of 40-50 square feet per 55 lb bag of EPDM granules installed with resin following manufacturer recommended ratios at approximately ¼ inch (6 mm) thick. Coverage will vary greatly with condition and/or type of substrate and application technique and so no guarantee of coverage is offered, expressed or implied.
STORAGE: Liquid materials (resin, solvent etc.) may be stored in their original, unopened container for up to one year from date of purchase between 59-77ºF (15-25ºC). Protect all liquid materials from freezing. Liquid material that has been frozen or is used more than one year after date of purchase is considered damaged, will have no warranty coverage and must be discarded in accordance with your local laws. Keep all rubber granule & silica materials dry and away from sources of heat.
PRECAUTIONS: For all materials, avoid contact with face, eyes and skin. Should any materials get into eyes, flood eyes repeatedly with potable water for 15 minutes and seek immediate medical attention. Do not rub eyes due to granular nature of the materials. Wash hands thoroughly after handling. Do not take internally. Always use a NIOSH certified respirator, face & eye protection and chemical gloves with long sleeves when handling any materials. Keep out of reach of children and away from animals. Should any rash or allergic reaction occur seek medical advice. Keep all containers closed and away from sources of heat when not in use. Resin is an isocyanate based polyurethane binder. Dispose of old or excess materials in accordance with your local laws. Consult Material Safety Data Sheets (MSDS) for further health and safety information including advise on transportation of materials.
LIMITED WARRANTY: Because the manufacturer has no control over proper substrate preparation or method of application, no guarantee as to results is offered, expressed or implied. The manufacturer guarantees against defects in supplied materials only for a period of up to 5 years for commercial & vehicle use applications and up to 10 years for residential foot-traffic only use applications or for the duration of time that the authorized installer or dealer guarantees the installation and labour for the project on which the materials have been used, whichever is shorter. Should the authorized installer or dealer fail to fulfill its installation and labour warranty obligations to its clients, the manufacturer accepts no responsibility of any kind for these claims. If supplied materials are found to be defective, replacement materials will be provided either free of charge or the defective material cost will be reimbursed at the manufacturer’s option. Labour, surface preparation, tools or any other associated costs are not covered by this warranty. Responsibility for claims of any kind is strictly limited to the original purchase price of the materials. Warranty claims to the manufacturer must be made in writing within seven days of discovering the defect or when should have been discovered with reasonable diligence. Materials are not guaranteed against wear, misuse, inadequate substrate preparation or inadequate installation process. Liquid materials used after one year from date of purchase or use of liquid materials that have been frozen will invalidate all warrantees. The manufacturer accepts no responsibility for any claims or statements made by the authorized installer or dealer to their clients regarding the suitability and performance of the materials installed. Supplied materials will not create a water-proof, water-tight or water-resistant surface and should not be sold as or used as such. Any warranty claim is limited to verified material purchases from Rubaroc only, if any materials used during installation are found to have been purchased from sources other than Rubaroc all warranties shall be void. Rubaroc materials are not suitable for underwater use in areas deeper than 3 feet (91 centimeters). Purchaser must inspect all orders upon arrival/pickup as any claims for materials damaged during transportation or missing from shipment shall be void unless damage is photographed and/or noted on the shipping bill of lading at the time of delivery.
RETURN POLICY: All sales are final. The manufacturer will not accept return of unused material under any circumstances. Purchaser is responsible for calculating their own material requirements and color ratios based on their individual requirement. Any guidance offered by the manufacturer regarding material requirements is based on its own historical installation experience only. Because the manufacturer has no control over installation size estimation, proper substrate preparation or method of application, no guarantee as to results is offered, expressed or implied. It is the purchaser’s sole responsibility to ensure they are ordering the correct quantities of any material.
COLORS: The manufacturer accepts no responsibility or liability for color variations of any supplied material. All samples should be used as a general guideline only when selecting colors. Color matching between orders cannot be guaranteed. Variations will range depending on the color selected and availability of raw material. Colors of samples are based on the manufacturer’s colors at time of sample production. Colors may vary and change at any time without notice due to changes in technology, location, availability and production. Colors may be unavailable or be discontinued without notice and may be substituted for the next available color. Temporary yellowing or ambering of resin binders is a normal environmental reaction and is not covered under the limited warranty. Pictures of rubber color may differ greatly from their actual appearance. Any warranty claims for inconsistency of delivered color shall be void unless photographed and reported to Rubaroc at time of delivery.

Rubaroc values and respects the privacy of our members and visitors. The purpose of this our Privacy Policy is to provide you with detailed information about how Rubaroc collects, uses and shares the information we collect through our website. We allow for our members to make individual choices on the information Rubaroc can access and use. Our collection process is used to improve the shopping experience of our members and to provide our website users with relevant information about our products, services and promotions.
Information we collect
Contact information. We may collect the names and user names of our members and visitors. We may also collect your purchase history, billing and shipping addresses, phone numbers, email addresses, and other digital contact information you enter while on Rubaroc.com. We may also collect information that you provide us about others (i.e. 'refer a friend' option).
Payment information. When a purchase is made we collect your payment information. This includes information from your credit or debit card, and PayPal account. MyRubaroc Members have the option to 'save' their banking information to their account for your convenience. This information remains private and cannot be accessed by third parties.
Returns information. When you return a product or request an exchange, you may be asked to provide your name, address, phone number and show a piece of valid government issued identification. Location information. If you use our website, we may collect location data obtained from your IP address or mobile phone. We use this data to find your nearest Rubaroc location.
Registration information. If you are a registered Rubaroc member, subscribe to our newsletter, request a quote, or contact customer support, we will collect personal information such as your name, email address, phone number and other information required to complete the application.
Payment Information
All prices listed on Rubaroc.com are in United States Dollar (USD) or Canadian Dollar (CAD). All orders must be paid for in full before processing can be completed.
